1. Overview

These Terms of Service govern use of beautydressy.shop and purchases made through the website.

Throughout these Terms, references to "we," "us," "our" and "beautydressy.shop" refer to the operator of beautydressy.shop.

By using the website or placing an order, you agree to these Terms to the extent permitted by applicable law.

These Terms do not exclude mandatory statutory rights available to consumers in Germany or elsewhere in the European Union.

2. Shopify

Our ecommerce website may be hosted or supported using Shopify technology.

Shopify provides the ecommerce platform used to offer products and services through the website.

Your purchase contract for products sold through beautydressy.shop is with the applicable operator or seller of beautydressy.shop, not with Shopify merely because Shopify technology is used.

3. Eligibility

You may use beautydressy.shop only for lawful purposes.

When placing an order, you represent that you have legal capacity to enter into the transaction or that the transaction is otherwise properly authorized.

You must provide accurate information during checkout.

4. Product Information

We make reasonable efforts to provide accurate:

• Product descriptions;
• Images;
• Specifications;
• Materials;
• Colours;
• Dimensions;
• Options;
• Availability information; and
• Pricing.

Minor variations may occur because of display settings, photography, production tolerances or manufacturing changes.

Nothing in this section limits statutory requirements that goods conform to their description and contract.

5. Prices

Applicable prices are displayed through the website before checkout.

Where required, applicable taxes or mandatory charges will be displayed or incorporated into pricing.

We reserve the right to change prices prospectively.

Price changes do not ordinarily affect an already concluded contract except where permitted by law.

6. Obvious Errors

We may correct genuine typographical, technical or pricing errors where legally permitted.

Where an obvious error affects an order, we may contact the customer before fulfilment and provide appropriate options consistent with applicable consumer law.

7. Orders

Submitting an order constitutes an offer to purchase the products identified during checkout unless applicable checkout wording or mandatory law provides otherwise.

Receipt of an automated acknowledgement does not necessarily constitute final acceptance where the law permits the contract to be concluded at a later stage.

Where an order is accepted, we will process it in accordance with these Terms and our applicable policies.

8. Right to Refuse or Cancel Orders

We may reject or cancel an order where reasonably necessary and legally permitted, including because of:

• Product unavailability;
• Suspected fraud;
• Unauthorized payment;
• Obvious pricing errors;
• Technical errors;
• Legal restrictions; or
• Inability to fulfil the order.

Where payment has already been collected for a properly cancelled order, the applicable amount will be refunded.

9. Payment

Customers agree to provide accurate payment information and authorize the relevant payment provider to process the amount shown at checkout.

Payment methods available to a particular customer are displayed during checkout.

10. Shipping

15–20 calendar days

EU rules ordinarily provide for delivery within 30 days unless another delivery timeframe has been agreed. Our stated 15–20 calendar-day estimate communicates the delivery period applicable to our standard shipping service, subject to exceptional circumstances described in our Shipping Policy.

11. Risk of Loss

Responsibility for goods during delivery will be determined in accordance with applicable consumer law.

Nothing in these Terms shifts transport risk to a consumer earlier than permitted by mandatory law.

12. Right of Withdrawal

Consumers purchasing eligible products through beautydressy.shop may have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to statutory exceptions.

The German Civil Code provides for a 14-day statutory withdrawal period.

13. Electronic Withdrawal

Where legally applicable to the transaction, an appropriate electronic withdrawal mechanism will be provided in accordance with requirements applicable from 19 June 2026.

This electronic option supplements other lawful means by which a consumer may communicate a withdrawal.

14. Legal Guarantee and Product Conformity

The statutory right of withdrawal is separate from rights regarding defective or non-conforming goods.

EU rules provide consumers with a minimum two-year legal guarantee for consumer goods.

Where goods are defective or do not conform to the contract, legally available remedies may include repair, replacement, price reduction or refund depending on the circumstances.

Nothing in these Terms excludes those rights.

15. Returns and Refunds

Returns and refunds are handled according to our Return and Refund Policy and mandatory applicable law.

Where a conflict exists between a voluntary store rule and a mandatory statutory consumer right, the mandatory statutory consumer right prevails.

16. Customer Responsibilities

Customers are responsible for:

• Providing correct contact information;
• Providing an accurate shipping address;
• Reviewing order details before checkout;
• Providing lawful payment authorization;
• Monitoring reasonable delivery communications; and
• Contacting us promptly if a problem arises.

17. Prohibited Uses

You must not use beautydressy.shop:

• For unlawful purposes;
• To commit fraud;
• To transmit malicious software;
• To interfere with website security;
• To attempt unauthorized access to systems or accounts;
• To scrape or harvest data unlawfully;
• To violate intellectual-property rights;

• To submit fraudulent payment information; or
• To interfere intentionally with another user's use of the service.

18. Intellectual Property

Unless otherwise stated, website content including text, layouts, graphics, branding, design elements and other protected material is owned by, licensed to or lawfully used by beautydressy.shop.

Nothing in these Terms transfers intellectual-property ownership to website visitors.

Customers may use website content for ordinary personal shopping purposes.

Unauthorized commercial reproduction, distribution or exploitation may be prohibited.

19. Third-Party Services

Certain functions may be supplied by third parties, including:

• Shopify;
• Payment providers;
• Shipping companies;
• Analytics providers;
• Customer-service systems; and
• Other ecommerce service providers.

Use of independent third-party services may also be subject to their applicable terms.

20. Website Availability

We aim to keep beautydressy.shop available and functional, but we do not guarantee uninterrupted access at all times.

Temporary interruptions may occur because of:

• Maintenance;
• Software updates;
• Hosting problems;
• Security incidents;
• Network outages;
• Third-party failures; or
• Events outside reasonable control.

Nothing in this section excludes liability that cannot legally be excluded.

21. Liability

To the maximum extent permitted by applicable law, liability may be limited where legally permissible.

However, nothing in these Terms excludes or restricts liability where exclusion or restriction would be unlawful.

In particular, nothing in these Terms removes mandatory consumer rights or other liability that German or EU law does not permit a trader to exclude.

22. Force Majeure and Events Outside Reasonable Control

We will not be responsible for delays caused solely by events outside our reasonable control to the extent permitted by law.

Such events may include severe weather, natural disasters, transport disruption, governmental measures, customs disruption, strikes, infrastructure failures or other extraordinary circumstances.

We will take reasonable steps to communicate material delays when practical.

23. Privacy

Processing of personal data is described in our Privacy Policy.

By using the website, customers are encouraged to review the Privacy Policy and applicable cookie settings.

24. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

The invalid provision will be interpreted or replaced only to the extent permitted by applicable law.

25. No Waiver

A failure to enforce a contractual right on one occasion does not necessarily constitute a waiver of that right on another occasion.

26. Governing Law

These Terms and purchase contracts may be governed by German law to the extent legally permitted.

Where the customer is a consumer habitually resident in another country, this choice does not deprive the consumer of mandatory protections that would otherwise apply under applicable conflict-of-law rules.

The former European Commission Online Dispute Resolution platform was permanently discontinued on 20 July 2025, so these Terms intentionally do not contain the obsolete ODR-platform link.

Any additional information regarding participation in a German consumer arbitration procedure must reflect the actual legal status and participation decision of the business under the German Consumer Dispute Resolution Act.

28. Amendments

We may update these Terms prospectively to reflect changes in:

• Our business;
• Website functionality;
• Shopify functionality;
• Applicable law; or
• Regulatory requirements.

The revised version will be posted on the website with an updated revision date.
